Who provides the service

NewsAndWins is operated by an individual based in Florida, United States (“NewsAndWins,” “we” or “us”). NewsAndWins is a service name, not a representation that a separate company or limited-liability entity exists. Contact support@newsandwins.com for support, legal enquiries and the legal operator’s details.

When these terms apply

These terms describe the conditions offered for the NewsAndWins website, mobile app and related workspace service. They become a contract with you only when validly accepted, including through a separate written agreement that incorporates this version. Publishing this page, inviting a user, or an administrator accepting for a workspace does not by itself establish that every individual member has accepted these terms. Visiting the privacy policy is not consent to additional data uses.

If you accept on behalf of an organization, you must have authority to bind it. An invitation, access code or administrator role does not itself establish that authority. An individual member does not become responsible for the organization’s payment obligations merely by joining its workspace. Any separately executed business agreement must identify the legal operator and customer. A separate written agreement signed by the operator and your organization controls where it expressly conflicts with these terms. Statutory rights that cannot be waived remain in force.

Access and your workspace

NewsAndWins is invitation-only; public signup is closed. Use only your own authorized account and keep passwords, access codes and recovery information confidential. Tell your administrator or support promptly about suspected misuse. A replacement access code must relate to the same technician profile. Access depends on current team membership and the permissions assigned to your role.

Organizations are responsible for authorizing members, choosing appropriate workspace content, providing necessary workplace notices and permissions, and managing their own records, employment obligations and retention requirements. Administrator status does not authorize access to another person’s private conversation. These responsibilities do not exclude obligations applicable law places on NewsAndWins. NewsAndWins does not replace an employer’s supervision, safety duties, payroll records or employment decisions.

Do not invite children under 13. Anyone accepting these terms must be legally able to enter the agreement. A minor’s use also requires whatever authorization and safeguards applicable law requires; an employer’s invitation alone does not resolve those requirements.

Acceptable use

Use NewsAndWins lawfully and for authorized work communication. Do not upload or send unlawful material, threats, harassment, sexual exploitation, scams, malware, or content that infringes someone’s privacy or intellectual-property rights. Do not impersonate others, misuse access codes, bypass permissions, probe another team’s information, disrupt the service or access data without authorization. Restrictions on reverse engineering apply only to the extent permitted by law.

Do not upload passwords, payment-card security details, highly sensitive medical information, or other regulated information requiring safeguards or agreements NewsAndWins has not specifically agreed to provide. A service demonstration is not a promise of suitability for a regulated use.

Your content and our software

You and your organization retain your existing rights in content you submit. You must have the rights and permissions needed to share it, including customer feedback, photos and recordings. Subject to a valid agreement and applicable law, you authorize NewsAndWins and its providers to host, copy, transmit, display and process that content only as needed to provide, secure and support the service and carry out your instructions. This is not permission to use private team content in advertising.

NewsAndWins and its licensors retain rights in the software, branding and service design. Authorized access gives you a limited, non-exclusive right to use the service for its intended purpose while that access remains valid, subject to applicable app-store license terms. It does not transfer ownership of the software.

Privacy, reporting and moderation

The privacy policy explains information handling, permissions, providers, private conversations and removal limits. Private conversations are participant-restricted in the app; the service is not end-to-end encrypted. Neither these terms nor an administrator’s agreement gives unrestricted consent to read or disclose private communications.

Use the report control to expressly share the selected item with designated support, or use the support page. A receipt does not mean a person has reviewed the report. Basic text screening is limited and does not analyze every attachment or detect every harmful message. We may remove or restrict content or access for misuse, security, legal requirements or violation of an applicable agreement. Reports are not an evidence-preservation service.

Availability, notifications and safety

NewsAndWins may be interrupted, delayed or unavailable because of maintenance, faults, connectivity, provider changes or device restrictions. No uptime, response-time or message-delivery guarantee is offered unless expressly agreed in writing. Verify that pending work has synced before relying on it or clearing device storage. Keep suitable copies of critical records.

Read receipts, acknowledgements, RSVPs, reminders and Recognition record app activity; they do not prove understanding, attendance, completed work or professional qualification. Weather, lightning information, movement checks and nearby reminders are best-effort aids. They are not emergency warnings, navigation, employee tracking or assurance that an activity is safe. Always park safely before using a phone as a driver and follow applicable workplace safety procedures. Contact local emergency services for immediate danger.

Features may differ by platform, version, permissions and team configuration. Demonstrations may use fictional data. Roadmap or preview features are not a commitment to deliver a particular feature or date.

Fees and third-party services

Any paid service requires separately disclosed pricing and agreed payment terms. This page does not create a subscription, authorize a charge or introduce automatic renewal. Your internet, mobile service and third-party products may have their own charges and terms. App-store and provider terms apply to their respective services.

Apple is not the provider of NewsAndWins’s workspace service or support. The applicable App Store license and usage rules continue to apply to the iPhone app; these service terms do not replace Apple’s standard license with a custom EULA. Other providers are responsible for their own services, subject to applicable law.

Ending access and deleting an account

You can stop using NewsAndWins and request account deletion through the app or account deletion page. Losing membership or signing out does not delete an account. The self-service flow requires owners to arrange a workspace handover before deleting their own account; contact support if that is not possible. Shared records, offline copies, backups and legal retention are subject to the limits explained in the privacy policy.

We may suspend or end access where reasonably necessary for security, unlawful activity, material misuse or the end of an agreed service. Where practicable and legally permitted, we will provide notice and an opportunity to address the issue. This does not waive applicable privacy rights or authorize destruction of records that must legally be preserved. We cannot guarantee recovery of content after deletion.

Warranty disclaimer

To the maximum extent permitted by applicable law, the service is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose or non-infringement, or a promise that it will be uninterrupted, error-free or meet every requirement. This does not exclude express commitments in a signed agreement or warranties and remedies that applicable law does not allow us to exclude.

Limits on liability

Where validly agreed and to the maximum extent permitted by law, NewsAndWins and its operator will not be liable for indirect, incidental, special, consequential or punitive damages, or lost profits, revenue or business opportunities arising from use of or inability to use the service. Aggregate liability under the agreement is limited to the greater of US$500 or the fees paid to NewsAndWins for the affected workspace during the 12 months before the first event giving rise to the claim.

These exclusions and the cap do not limit liability for fraud, fraudulent misrepresentation, willful misconduct, gross negligence, death or personal injury caused by our negligence, or liability that cannot lawfully be excluded or limited. They do not remove non-waivable consumer, privacy or data-protection rights. These terms do not assert that a person who has not validly agreed is bound by this allocation of risk.

Law, disputes and changes

Where these terms form a valid agreement, Florida law governs without its conflict-of-law rules, except that mandatory rights under applicable law remain available. These terms do not impose mandatory arbitration, a class-action waiver or a restriction on contacting regulators or bringing a claim in a court that applicable law entitles you to use. Contact support to try to resolve a concern; doing so is not a prerequisite to exercising a legal right or meeting a deadline.

We may publish revised terms with a new date and version. Revisions apply prospectively only through valid notice and acceptance where required, and do not silently change an existing agreement or past dispute. If a provision is unenforceable, the remaining valid provisions continue to apply to the extent permitted by law. Failure to enforce a provision once is not a waiver for the future.
